Christmas Carols Performance License Agreement

This Agreement governs the use of the Christmas Carols bundle (recordings and backing tracks) for school or community performances.

This Christmas Carols Performance License Agreement (“Agreement”) is entered into between Party Bands, LLC d/b/a PlymouthRock.org (“Licensor”) and the purchasing school, choir, or organization (“Licensee”).

By purchasing, downloading, or using the carol recordings and materials, Licensee agrees to the terms of this Agreement.

1. Licensed Materials

This Agreement covers the use of the Christmas Carols bundle (e.g. christmas_carols_bundle.zip), which typically includes:

6 Christmas carol arrangements with melody vocals (MP3)
6 matching backing tracks without lead vocal (MP3)
Lyrics sheets (PDF)
Any accompanying notes or performance suggestions

All materials remain the intellectual property of Licensor and are protected by applicable copyright laws.

2. License Grant

Licensor grants Licensee a non-exclusive, non-transferable, limited license to:

Use the licensed carol recordings and backing tracks for rehearsals and performances by the licensed school, choir, or organization during the current holiday season; and
Perform the carols live at one or more events hosted by or directly connected to the Licensee (e.g., school concert, holiday assembly, community program).

3. Permitted Uses

Under this Agreement, Licensee may:

Rehearse the carols with students, choir members, or ensemble performers.
Use melody-vocal tracks as a learning tool or for small events.
Use backing tracks (no lead vocal) for live performances.
Print and distribute lyrics sheets to participating singers for use during rehearsals and performances.
Perform the carols at holiday events that are free or modestly ticketed in keeping with typical school or community choir practice.

4. Prohibited Uses

Licensee may not:

Resell, sublicense, or distribute the recordings or backing tracks as standalone audio products.
Upload full-length, high-quality audio tracks to public streaming or download platforms.
Make studio-style commercial releases or monetized digital singles from these recordings without separate written permission from Licensor.
Remove or obscure any copyright notices or watermarks associated with the carol recordings or documentation.
Share the digital files with other schools, choirs, or organizations not covered by this license.

5. Recording and Streaming

Licensee may make audio or video recordings of live performances of the carols for archival or private sharing (e.g., password-protected link to families) provided that:

Recordings are not sold as commercial products; and
Any online sharing is limited to a reasonable, access-controlled audience (such as families and school community).

Public streaming, broadcast, or large-scale monetized releases may require additional permissions or a separate streaming license.

6. Intellectual Property

All rights, title, and interest in and to the Christmas Carol arrangements, recordings, backing tracks, and associated materials are owned by or licensed to Party Bands, LLC d/b/a PlymouthRock.org.

7. Credit Requirement

In concert programs, digital descriptions, or on-screen credits where feasible, Licensee agrees to include the following credit (or substantially similar wording):

“Christmas Carols arrangements and backing tracks licensed through PlymouthRock.org”

8. Term and Territory

This License becomes effective on the effective date listed below and remains in effect for the current holiday season (typically through the end of the calendar year).

The License is limited to performances taking place within the usual geographic area of the Licensee’s school or organization and its typical performance venues.

9. Termination

Licensor may terminate this Agreement if Licensee breaches any of its terms. Upon termination or expiration, Licensee agrees to:

Cease further performances using the licensed recordings and backing tracks; and
Delete digital copies of the recordings from devices and platforms not needed for archival purposes.

10. Warranty Disclaimer

The recordings and backing tracks are provided “as is,” without warranty of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. Licensor is not responsible for playback compatibility on specific devices or systems.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict of law provisions.

12. Acceptance

Use of the carol recordings, backing tracks, or lyrics under this bundle constitutes the Licensee’s acceptance of this Christmas Carols Performance License Agreement.
