Rockin’ The Secrets of Plymouth Rock™
Digital Streaming Add-On License Agreement

This Agreement governs limited digital streaming rights for Rockin’ The Secrets of Plymouth Rock™ as an add-on to a valid live performance license.

This Digital Streaming Add-On License Agreement (“Agreement”) is entered into between Party Bands, LLC d/b/a PlymouthRock.org (“Licensor”) and the purchasing educational institution or organization (“Licensee”).

By purchasing, downloading, or using the streaming materials, Licensee agrees to be bound by the terms of this Agreement.

1. Relationship to Live Performance License

This Digital Streaming Add-On License is valid only when paired with a current, valid live performance license for Rockin’ The Secrets of Plymouth Rock™ (e.g., Single-Class, School, or District License).

The Streaming Add-On does not grant any live performance rights by itself; it expands an existing license to include limited online viewing, as described below.

2. License Grant

Subject to the terms of this Agreement and the underlying live performance license, Licensor grants Licensee a non-exclusive, non-transferable, limited license to:

• Capture a video recording of the licensed production of Rockin’ The Secrets of Plymouth Rock™ during the licensed term; and
• Make that recording available for on-demand or scheduled streaming to students, families, and the school community as described in this Agreement.

3. Licensed Streaming Materials

The Digital Streaming Add-On typically includes a downloadable package (e.g. plymouthrock_streaming_addon.zip), which may contain:

• Streaming License Agreement (PDF)
• Watermarked audio tracks intended for streaming use (MP3)
• Watermarked script or lyric PDF suitable for limited on-screen display
• Streaming guidelines and suggested audience communication language

4. Permitted Uses

Under this Digital Streaming Add-On, Licensee may:

• Record a single production of the show (based on the licensed live performance rights).
• Host the resulting video on a password-protected or access-controlled platform, where only students, families, and school community members may view it.
• Provide access to the stream for a limited time window (for example, a multi-day “viewing window” agreed upon by the school and Licensor’s guidelines).
• Use watermarked audio tracks and documents provided solely for the purpose of this production’s recording and streaming.

5. Prohibited Uses

Licensee may not:

• Make the recorded production publicly available (e.g., unrestricted on YouTube, Vimeo, Facebook, or other public sites).
• Sell or rent access to the stream as a commercial product without prior written permission from Licensor.
• Edit the show in a way that materially alters the script, lyrics, or musical compositions.
• Extract and repurpose audio, video, or images from the recording for unrelated projects.
• Remove watermarks or copyright notices from audio, video, or document files associated with the Streaming Add-On.
• Allow indefinite, ongoing access to the stream outside of the agreed streaming window without a renewed license.

6. Technical Platforms and Security

Licensee is responsible for choosing a secure streaming platform (such as a password-protected school video portal, private link, or similar solution) that reasonably restricts access to the intended audience.

Licensor does not provide or operate the streaming platform and is not responsible for technical issues, outages, or data privacy policies of third-party platforms chosen by Licensee.

7. Intellectual Property

All rights, title, and interest in and to Rockin’ The Secrets of Plymouth Rock™, including the script, lyrics, music, characters, artwork, and recordings, are owned by Candido Bretto and licensed by Party Bands, LLC d/b/a PlymouthRock.org.

Copyright © 2025 Candido Bretto / Party Bands, LLC. All rights reserved. Nothing in this Agreement transfers ownership of the materials to Licensee.

8. Credit Requirement

In any on-screen titles, description text, or digital program accompanying the stream, Licensee agrees to include the following credit (or substantially similar wording):

“Rockin’ The Secrets of Plymouth Rock™ by Candido Bretto
Licensed for streaming through PlymouthRock.org”

9. Term and Termination

This Digital Streaming Add-On becomes effective on the effective date listed below and remains in effect for the streaming window associated with the licensed production, as agreed or reasonably interpreted from the purchase terms (e.g., a 30–90 day access period).

Licensor may terminate this Agreement immediately if Licensee breaches any term of this Agreement or the underlying live performance license. Upon termination or expiration, Licensee agrees to:

• Disable access to any hosted recordings of the production; and
• Delete any downloadable files from streaming platforms that are not necessary for archival school records.

10. Warranty Disclaimer

The digital streaming materials and associated files are provided “as is,” without warranty of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. Licensor is not responsible for technical issues, bandwidth limitations, or platform outages affecting viewer access.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict of law provisions.

12. Acceptance

Use of the streaming materials, and/or the act of recording and streaming the production under this Add-On, constitutes the Licensee’s acceptance of this Digital Streaming Add-On License Agreement.
